Hughes News: DNA Denied

The Chapter 64 motion for DNA testing has been denied. In Texas, a person facing execution is not allowed to have his DNA compared against the DNA claimed by Texas to be the killer's DNA.

Awaiting responses on two civil suits.

Been preparing an appeal to the CCA of the trial court's denial for DNA testing. It should be filed within the hour (3 PM local).

Can the Chap. 64 motion be appealed to the U.S. Supreme Court in the short time we now have left?

I don't understand!A law was voted especially for Hank SKINNER,to allow DNA testing even after a conviction!
Why not for Preston?

What was the actual denial on the petition?

The problem is that the defense asked for DNA testing earlier and they got it, but they asked for the wrong things and the results they got they didn't like. Did the defense ask for and get denied access to DNS testing on these other objects?

I am not all too familiar with the Skinner case, but I'm sure something similar happened whereby some exhibits were previously tested and others were not. Furthermore, Chap. 64 allows for items NOT PREVIOUSLY tested so logically, I can find no rational reason for the CCA's decision.

That is a totally absurd law!! The state says the DNA belongs to the killer, a person has been convicted of being the killer without the DNA being tested, but yet a state law says they can't test the DNA to be 100 % sure???? So go ahead and execute? I can't print what I want to say so I'm at a loss for words right now. dgr

BAD news: Gloria (execution watch/radio show)said that they will execute him!!!!!!!!!!!!WRONG!!
